The New Jersey Storage Tank Act
The New Jersey Storage Tank Act was passed in 1986. This requires the removal, replacement, or modification of various underground storage tanks by December 22, 1998 . By that date, underground tanks regulated by state law must have met state and federal specifications for spill protection, overfill protection, and corrosion protection.

Oil tanks are one type of tank covered by the act. Other types of tanks included in the act are motor fuel, hazardous substances, and hazardous waste, however theses do not impact PSE&G. With respect to oil tanks, the act covers:

  • All non residential (business and industry) tanks of capacities of 2,001 gallons or more that store oil for on-site consumption.
  • All commercial (fuel oil dealer) tanks that store oil for sale or distribution.
  • Act covers only those tanks installed prior to December 22, 1988.
Compliance
NJ businesses and industries must take of the following three actions to comply with the act:
  • The existing tank can be upgraded with spill protection, overflow protection, and corrosion protection.
  • The existing tank can be closed.
  • The existing tank can be replaced with a new underground tank that has spill, overflow, and corrosion protection.
Those who did not comply with the New Jersey Storage Tank Act could face stiff penalties and fines.
